Sell your second hand car

It is very likely that sooner or later, we will see ourselves buying or selling a second-hand car. Whatever role we are in, it is important never to forget the importance of car purchase agreement. The purpose of both parties filling out and signing a car sales contract is to make it clear under what conditions a car, or any other vehicle, is purchased, to avoid unpleasant surprises afterwards and clearly define the responsibilities of each party.

A sales contract can be drawn up freely, each one will consider what is appropriate to include in it. Of course, in no sales contract model The full name and ID of the two parties may be missing, all the data of the vehicle to be transferred and the signature of the buyer and the seller on all the pages of the vehicle sales contract.

Details of the car purchase contract

Registration year registration date

It is important to collect all the data of the vehicle in the purchase contract

The more rigorous we are when drafting our sales contract model, the clearer the transfer will be and more problems we can avoid in the future, whether we are the buyer or the seller. The following data cannot be missing in any sales contract:

  • Name, surnames and ID of the buyer and seller
  • Signature of the buyer and seller on all pages of the sales contract
  • Description of the car: brand, model, version, finish, engine, extras included. For example: Seat León ST Style 1.5 EcoTSI 130 CV with leather upholstery.
  • Vehicle data: license plate, chassis number and mileage
  • State in which it is located. For example: worn clutch, broken suspension silent blocks...
  • Price to pay for the vehicle
  • Payment method
For the price, the best thing you can do is use a free online appraiser. That gives you an idea of market prices:

Contract for the sale of used vehicles

Note: Some private sellers they do not have to have clear data about the car like the finish or the extras. However, it is not necessary to fill in all the data compulsorily. It is rather about that everything that is mentioned about the car during the sale is reflected. If it has been said that the car had a 130 hp gasoline engine, let it be reflected to avoid scams or misunderstandings. Something very common in second-hand purchases, especially among individuals.

If the car has any kind of defect or irregularityespecially mechanical it is important to state in the contract, so that in the event that we are the seller, the buyer cannot claim us for that concept. Many times the words, despite the good intention, can fall on deaf ears. Important, sign two copies of the contract, one for each of the parties.

If the sale is made to an individual

  • The first thing to do is sign the relevant car sales contract in duplicate. This document, of an internal nature for the parties, and binding from the moment of its signature. It must include the day and time on which the vehicle is delivered to the buyer, because if problems arise after this moment (such as fines) it will help us to clarify responsibilities.
  • Along with the sales contract, the seller must Keep a photocopy of the buyer's ID.
  • After completing these steps, the buyer has a term of 15 days to deliver a copy of the circulation permit to the seller stating that the car is no longer your property. After this period, if the buyer has not fulfilled its commitment, the seller must communicate in the Nearest Traffic Headquarters that the vehicle is no longer your property. To do this, the seller must complete the form "Procedure of notification of sale" that will be provided at the headquarters.

The sale is carried out to a professional

  • The first thing they should give us is a copy of the bill of sale. In it (and as in the case of individuals) the day and time in which we deposited the car at the dealership must appear.
  • Una copy of the company's CIF that acquires the vehicle (it must appear on the bill of sale).

If you have any questions, leave us a comment and we will help you with all the questions you have in relation to the car sales contract.

How to avoid scams when buying a car

Avoid scams in the sale of vehicles

A good car purchase agreement

Since you are reading this article, we assume that you will at least use a proper sales contract. However, this only covers your back in part when the operation is between individuals. If the information that appears in it is not real or false documents are accepted as true, we can end up being victims of a scam.

Check if the car is seized or has loads

You would not be the first or the last to buy a car that is repossessed or has charges, because the owner wants to get rid of it. If that is so, it means that there is a third party who has rights over it, be it a bank, a dealer or the Tax Agency.

Be careful if a car is repossessed

Any of these entities can keep the car even if you bought it. So you could be left without the vehicle and without the money, if later you can't locate the seller or he no longer has money. Take a look at the article How to know if a car is repossessed or has loads. In it we explain how to get rid of doubts easily.

Check documentation and data

The DNI of the member countries of the European Union has many anti-counterfeiting measures, but there is nothing that cannot be falsified with the appropriate means. Therefore, it is important that you look closely at the ID of the person with whom you make the transaction. The best way you have to detect if it is not authentic, is to compare it with your own and be meticulous, although here we leave you a description of its parts.

Beware of scams when buying a second-hand car

It is also recommended to check that the phone and address of the person with whom you make the deal are real. The same goes for the vehicle documentation, so notice that the frame number (in the papers and the car itself), the registration y other data They are the same ones that appear in the contract of sale.

Beware of private sellers representing owners

The data that appears in the contract of sale must be that of the owner, not that of an outside private seller. The signature must also be that of the owner and must be clear. As a buyer, the only way to be sure it's not a fake is to that the owner shows you his ID and signs the contract in your presence. This way you can see if the photo of the DNI corresponds to the person who signs.

You do not trust individuals on behalf of others

Do not take valid proof of payment from the buyer

It seems obvious, but for people who are not familiar with these operations, they can be easily fooled. It has to be your own bank that notifies you that the money is in your account. Therefore, you should not accept as valid proof of income that the buyer shows you or sends you.

If you do, you may fall victim to scams like the empty envelope scam. They perpetrate this deception by obtaining proof of income by putting an empty envelope in an ATM and showing it to the seller. However, that income will never reach the destination account, because when the bank workers open the envelope they will see that there is nothing inside and they will cancel it.

hello good, I wanted to know if I buy a car from a private individual, but the car and he are from Lithuania, but I am going to do the paperwork here in Spain, since they bring it to me here, but my doubt is if the contract is foreigner of purchase and sale is the same model as the one in Spain or is there a specific one for this case?

    1.    José Antonio Martínez said

      Good morning Serge

First of all I want to tell you something. You mention that both the seller and the vehicle are in Lithuania and that the car is brought to Spain while you do the paperwork for its purchase in our country. I warn you, that unless you know the seller in person and have full confidence in him, do not make the purchase, as it could be a scam. In these cases, before buying the vehicle, it is advisable that you see it, touch it and test it; and as I understand, you have not done any of these things that I indicate.

Another important issue is that without knowing or seeing, do not pay any money in advance, because that is where the scam would be. You pay in advance, arrange documentation and so on, and then the car never arrives at the destination. Pursuing these people is very difficult, as they often hide behind false names and unclear information. Keep an eye on this topic.

Regarding the purchase contract, you will need the Spanish one to present it to the Headquarters of Traffic in Spain and the Lithuanian one (there must be a model but I don't know which one) so that there is evidence of transparency in the transaction. My advice is that the seller provides you with a copy of the vehicle documentation (complete), another of his passport (where his current residence appears) and contact information (which I understand you will have). In this way, you would have to have three copies of the Spanish contract of sale and another three of the Lithuanian contract.

I hope I have resolved your doubt and more importantly, save you a problem if you were unaware of the situation.

      All the best

    Hello dear friends of Actualidadmotor!
    My name is Victor.
I have just started the procedures to sell a Seat 850D Especial, registered on 12/April/1971.
    (He just turned 47).
I am writing to you because I have a question regarding the documentation… Everything is in order:
1st. Circulation Permit… the car is in my name (the original was in my father's name).
2nd. Vehicle Technical Inspection Card... original, with a lot of ITV inspection stamps.
3rd. Insurance Policy… the policy contract is in my name and I have renewed the policy for another year, just fifteen days ago.
4th. IVTM '17 a day... the tax is domiciled and in a few weeks, I will pay the corresponding to the year 2018.
5th. Last ITV inspection report… favorable with minor defects! dated April 11, 2018.

The issue that has me confused and about which I have doubts, is that when the purchase-sale is finally carried out, the two copies of the contract are signed, the payment for the vehicle is made... What documentation, of the one I have listed above, I must deliver to the buyer together with the car…? I have special doubts about the insurance policy... I understand that it is a private contract, between the insurer and the insured/policyholder, therefore, is it a document that the seller should keep and consequently cancel the policy...?
I think that the other documents should be delivered together with the cars, but I'm not sure about it... could you answer this question, please? I would be very grateful to you. (I even keep the original of the Luxury Tax payment letter and the Circulation Permit for 2nd category cars from the Ministry of the Interior at the time).
Should I make any photocopies of them…? Is it convenient for some reason…?
Thank you very much for reading this far.
    Greetings.

Hello, I am going to sell my used car and I would like to know the steps, that is:
    – 1º we sign the purchase contract with date and time, stipulating the price and payment method, and delivering all the documentation of the vehicle,
    – 2nd at that moment I give him the car
    – 3º the buyer is in charge of the procedures in traffic and finance
    – 4th after 10 days I check in traffic that the car is already in the name of the buyer.

Please confirm this to me as soon as possible.

One more thing, if they make me the installment payment, in this case in 3 months, I stipulate it in the contract too, right?

    Thank you!!

    Good afternoon.
I am going to buy a vehicle from a company... an agency will process it and they tell me that they will immediately give me a provisional driving permit while waiting for the definitive permit in my name.

At the moment that I have this provisional permit, it means that the transfer has been carried out without any problem and I can pay for the vehicle without there being the possibility that it will take longer... due to problems with the vehicle, they will not give me the definitive transfer...

In other words, when they give you the provisional circulation permit, it means that the vehicle has no problems being transferred and then I can make the payment with peace of mind not to encounter any inconvenience later.

    THANK YOU.
